Choosing a provider

How to choose a duty drawback company.

Drawback providers differ less in whether they have software and more in how much of the work they actually do. Five questions worth asking any of them, including us.

Is the provider a licensed U.S. Customs broker?

Filing and defending a claim before CBP is customs business. A software vendor that is not a licensed broker cannot file on your behalf or represent you on review, which means part of the work returns to you.

How are imports matched to exports?

Sequence-based matching is the default in most systems and it leaves recoverable duty behind. Ask whether the provider optimizes across every compliant combination, and ask them to show you the difference on your own entries.

Who collects the supporting documents?

Entry data comes from ACE and export documentation comes from your brokers and forwarders. Ask whether the provider retrieves it directly or expects your team to gather and submit it.

Who defends the claim on CBP review?

A claim is not finished when it is filed. Ask who responds to CBP requests, who handles protests and prior disclosures, and whether that is included or billed separately.

What happens to duty that goes unmatched?

Unmatched duty stays available to future qualifying exports inside the five-year window. Ask whether the provider tracks and carries it forward, or simply reports it and moves on.

Duty drawback, answered.

The questions importers and exporters ask us most often.

What is duty drawback?

Duty drawback is a refund of up to 99% of the duties, taxes, and fees paid on imported merchandise that is later exported or destroyed. It is one of the few lawful ways to recover money already paid to U.S. Customs and Border Protection.

How far back can we claim drawback?

Drawback claims must be filed within five years of the date of importation. A newly implemented program can often recover on several years of prior import and export activity, which is why the first filing is frequently the largest.

Which duties and fees are recoverable?

Regular ordinary duties, Section 301 duties, and merchandise processing fees are generally recoverable through drawback. Section 232 eligibility is set proclamation by proclamation, and antidumping or countervailing duties are not drawback eligible.

Do we have to manufacture to qualify?

No. Unused merchandise drawback under 19 U.S.C. 1313(j)(1) and 1313(j)(2) applies to goods exported in essentially the same condition as imported. Manufacturing drawback under 1313(a) and 1313(b) covers merchandise used in production.
